This website, geargains.fit, is operated by GearGains, based in Melbourne, Victoria, Australia. Throughout these Terms, "GearGains", "we", "us" and "our" refer to GearGains. By visiting our website or buying from us, you agree to these Terms of Service, along with our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, please do not use the website.
Our store is hosted on Shopify, which provides the e-commerce platform that lets us sell our products to you.
2. Using our website
By agreeing to these Terms, you confirm that you are at least 18 years old, or that you are using the website with the consent and supervision of a parent or guardian. You must not use our products or website for any illegal or unauthorised purpose, or attempt to interfere with the website's security or operation.
3. Products and information
We work hard to describe and display our products accurately, including sizes, specifications and colours. Colours may look slightly different depending on your screen. Product availability, descriptions and prices may change without notice, and we may limit quantities or discontinue products at any time.

4. Supplements
Our supplements are not intended to diagnose, treat, cure or prevent any disease. Always read the label and use only as directed. If you are pregnant or breastfeeding, under 18, taking medication, or have a medical condition, speak with your doctor before using any supplement. Supplements should not replace a varied and balanced diet.
5. Training equipment and recovery tools
Exercise carries a risk of injury. Use all equipment and recovery tools as instructed, check them for wear or damage before each use, and stop using any item that is damaged. If you are new to exercise or have an injury or medical condition, speak with a qualified health professional before starting a new program.
6. Pricing and payment
All prices are shown in the currency selected on the website and include GST where applicable. Shipping costs are calculated at checkout. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full, even after it has been placed. Payment is processed securely through Shopify and our payment providers. We do not store your full card details.
7. Orders
We may refuse or cancel any order, including orders that appear to be fraudulent or placed by resellers. If we cancel your order after payment, we will contact you using the email you provided and give you a full refund. Please make sure your contact and delivery details are correct and up to date.
8. Shipping, returns and refunds
Delivery times and costs are set out in our Shipping Policy. Returns and refunds are handled under our Refund Policy.
9. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
